梁振英向澳洲傳媒發律師信曝光【14時20分消息】澳洲傳媒Fairfax Media踢爆行政長官梁振英上任前與澳洲UGL企業有秘密協議,涉及5000萬港元利益。負責這宗調查報道的John Garnaut向《蘋果》在內的多間本港傳媒提供梁振英發出的律師信文本,內文顯示澳洲傳媒曾以「許仕仁案」相提並論,梁振英則透過律師嚴正否認有關指控,並指報道涉及誹謗,並損害梁振英聲譽,梁振英保留法律追究權利,限令Fairfax Media於10月8日下午12時30分前回覆,而最終Fairfax Media於當日刊出報道。

Proposed Article Regarding Mr CY Leung
We act for Mr Chun-Ying Leung who is currently the Chief Executive of the Hong Kong Special Administrative Region.
We are instructed that one of your journalists, John Garnaut, has prepared an article about our client regarding his alleged commercial dealings with the company UGL Limited and that Mr Garnaut intends to publish the article, imminently, in both the Sydney Morning Herald and The Age.
In an email dated 6 October 2014 from Mr Garnaut to Mr Michael Yu (an officer of the Chief Executive’s Office) (the Email), Mr Garnaut discloses the nature and scope of the proposed article. From the questions contained in the Email, it is apparent that Mr Garnaut intends either expressly, or implicitly, to allege that our client has been involved in accepting bribes and/or secret commissions from UGL Limited, and that he has failed to make a declaration of such interest. These allegations are strenuously denied by our client, and as stated by the Chief Executive’s Office in its reply to you yesterday, it is erroneous to suggest that such a declaration is required in Hong Kong. These unfounded allegations, if published, carry defamatory imputations that will damage the reputation of our client, those imputations being that he is:
1. a corrupt public official;
2. unethical;
3. willing to engage in fraudulent activity at the public’s expense for his own gain;
4. dishonest; and
5. not a fit and proper person to hold public office.
Further to your Email and for your information, the hearing regarding the criminal trial of Mr Rafael Hui and the other four defendants is continuing in the High Court of Hong Kong and is in its 91st day of hearing.
Our Hong Kong associate lawyers have been attending the same trial on behalf of one of the defendants. They are completely conversant with the prosecution case and the evidence so far adduced by the prosecution and the defendants. Further, they have advised that the assertion contained in Mr Garnaut’s Email that the payment to Mr Leung appears to be "analogous to the transaction that has landed Rafael Hui in court, ie it is a bribe in exchange for Mr Leung’s leveraging his official connection” is totally wrong and the comparison is entirely unjustified as the facts of that case affecting Mr Rafael Hui are completely different from Mr Leung’s situation.
Consequently, if Fairfax Media Limited publishes its intended article containing any of the allegations that carry the aforesaid defamatory imputations, our client will reserve his rights to take appropriate legal action against it and Mr Garnaut personally.
Please confirm by no later than 12:30pm on 8 October 2014 that Fairfax Media Limited will not publish the intended article with those unfounded and libellous allegations.
