Eva Carneiro takes legal action against Jose Mourinho



Jose Mourinho is to be the subject of an individual legal claim from former Chelsea team doctor Eva Carneiro.

Legal papers will be served on Mourinho this week as part of separate but connected claims against him and against the club.

It means that Mourinho will have to appear in person at an employment tribunal unless the case is settled out of court beforehand.

Under employment law, an individual can be personally liable for damages if victimisation or discrimination can be proved.

The claim against Mourinho will be on the basis that he was instrumental in the actions against Carneiro in having her dropped from first-team duties and effectively demoted.

The latest development will heap even more pressure on the 52-year-old who has seen his side lose six out of 11 matches in the Premier League so far to leave the reigning champions in 15th spot in the table.

The controversy over Carneiro goes back to August 8, the opening day of the season, when Mourinho criticised her and head physio Jon Fearn for going on to the pitch to treat Eden Hazard after being called on by referee Michael Oliver.

The action meant that Chelsea were temporarily down to nine men against Swansea, and afterwards Mourinho called Carneiro and Fearn "impulsive and naive".

Carneiro did not appear on the bench again for first-team duties and is now seeking a claim for constructive dismissal after parting company with the club.

The doctor's lawyers said neither she nor they could comment as the case is sub judice. Chelsea did not respond when asked if they wished to comment.

Mourinho was cleared of using discriminatory language towards her following an investigation by the Football Association, which caused further controversy after Carneiro revealed she had not been spoken to personally during the investigation, nor asked to provide any statement.

The FA's chief executive Martin Glenn and head of governance Darren Bailey are to be quizzed about the handling of the case by the governing body's Inclusion Advisory Board (IAB) later this month.

The IAB's chair Heather Rabbatts is under investigation by the FA following her comments criticising officials for not speaking to Carneiro in person during the Mourinho investigation.

車路士前隊醫伊娃，因為聯賽對史雲斯一役，被領隊摩連奴批評擅自進入球場，為受傷的夏薩特治理，最後決定辭職，並且告狀摩佬，為自己討回公道。至於事件的關鍵人物是當時受傷的夏薩特，而他有否要求軍醫入場治理，成為事件的重要點，故伊娃決定起訴摩佬，夏薩特將有機會成為證人，以使判決更加公正。伊娃2009年加入車路士，兩年後替一隊工作，直至今年8月。

Jose Mourinho's Chelsea departure has opened the door for a possible Stamford Bridge return for Eva Carneiro.

Sky sources understand a number of senior players remain upset at the way in which the popular doctor left the club.

Carneiro remains out of work and still lives close to the Chelsea training ground in Cobham.

Lawyers for all sides are due to come face-to-face on January 6 ahead of a potential full employment tribunal in June.

Last month Carneiro lodged claims for sex discrimination against Mourinho - claims for which he is still liable for despite his departure from the club.

Carneiro also claimed reinstatement at the club along with personal injury compensation and aggravated damages from the club.

Chelsea and Mourinho had 49 days to register their defence against those claims - and as things stand, it is understood that no defence (or ET3 form as it is known) has been lodged with the tribunal from either the former manager or the club - and neither have asked for an extension.

It is difficult at this stage to conclude what will happen now but Chelsea may look to settle the five-month dispute in the coming weeks.

伊娃卡妮路（Eva Carneiro）去年9月被球會終止合約，全因她在1個月前對史雲斯的英超開鑼戰時，因入場替夏薩特治理傷勢，與摩連奴（Jose Mourinho）發生嫌隙，最後「冇得留低」。伊娃及後入稟法院，控告車路士無理解僱及摩連奴性別歧視，而她在英國時間周一早上出席閉門聆訊，尋求庭外和解，車仔也有派代表出席，但伊娃的代表律師瑪莉奧洛姬在聆訊後證實，事件未解決，皆因他們要求摩佬必須先公開道歉才「有偈傾」。

瑪莉奧洛姬接受訪問時說：「我們已料到糾紛不會在今天得到解決，一方面，兩方在賠償金方面有很大出入，而且我們需要摩連奴公開道歉。」

42歲的伊娃在去年12月入稟法院，正式發律師信控告當時剛被炒的摩連奴及藍軍，而1月曾出席了歷時3小時的聆訊，但問題未獲解決。假如雙方經過這次會面後，也無法在庭外得到共識，那麼案件將會根據預先的安排，進入司法程序，會在6月有判決。假如伊娃勝訴，將會獲得逾百多萬的賠償金。
