Chelsea and Eva Carneiro are understood to have parted company, with the English champions now bracing themselves for what could prove an expensive legal battle.The now former Chelsea first team doctor was ordered to return to work last Friday for what would have been her first appearance at the club's Cobham training ground since an incident during the Premier League encounter with Swansea City on August 8.
But Carneiro did not show up and according to club insiders she had still not been seen there, with it now clear that she has in fact departed the club.Chelsea may argue that her failure to show for work could weaken her case for constructive dismissal, even though arriving at Cobham would have amounted to accepting the new terms of her employment after being publicly stripped of first team duties.
Sportsmail understands that Chelsea are aware that the Gibraltar-born medic is consulting top employment lawyers.Carneiro was stripped of key duties after Mourinho accused her of making a mistake when she and team physiotherapist Jon Fearn rushed on to the pitch to treat Eden Hazard, having twice been waved on by referee Michael Oliver. Carneiro was banned from the bench and the team hotel as a part of her punishment.Mourinho's explosive reaction at the time is now the subject of an FA inquiry after a member of the public made a complaint, claiming – as Sportsmail revealed last week – that the Portuguese manager had shouted 'filha da puta'; something that means daughter of a whore and, if proven, could lead to Mourinho being banned for five matches. FA officials said on Monday the video evidence that was submitted as part of the complaint was still being reviewed.
Carneiro was subjected to severe public criticism by Mourinho after the game as well. In a post-match interview he accused his medical staff of being naive and not understanding the game, even though Carneiro had been the Chelsea doctor for five years.
This has been met with widespread disapproval by the Carneiro's peers in the medical profession as well as the football authorities. The chief medical officer at FIFA was among those to remind Mourinho that the welfare of players remains the responsibility of medical staff and not the manager.
Indeed, a joint statement from the British Association of Sport and Exercise Medicine and the 500-strong Faculty of Sport and Exercise Medicine has been sent to the League Managers' Association.
The FA's position remains unclear. While it seems unlikely, Mourinho could yet be charged under the FA rule E3, which states that players and coaches can be punished for using 'offensive, insulting or abusive language and/or gestures'. An aggravated breach, in this case possibly with reference to gender, a five-match ban is the minimum sanction.
'We understand that the manager allegedly calls Eva "Filha da Puta" at pitchside,' says the complaint with the support of a "native Portuguese speaker". 'The abuse is allegedly directed to her because "Filha" is feminine and singular in Portuguese and to be directed at a man or at a group of people would have to be "Filho" or "Filhos".
'Additionally it could be considered that the offensive comment was aimed at the club doctor specifically as she speaks Portuguese. By all accounts, the equivalent to this expression in English would be "son of a bitch" in the masculine, but "daughter of a whore" in the feminine.'
Concern has been expressed in football circles that the FA have been slow to respond to this case.
The game took place on August 8 with the complaint, prompted by a lack of action from the FA, following on September 8. That, of course, was 14 days ago and still no decision on whether Mourinho should be charged has been taken.
